These Terms and Conditions (“Terms”) govern your access to and use of the Shiply Global website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using Shiply Global, you confirm that you have read, understood, and agreed to be bound by these Terms.

1. Definitions

• “Shiply Global”, “we”, “us”, or “our” refers to the marketplace platform operator.

• “User”, “you”, or “your” refers to any person accessing or using the Platform.

• “Fulfillment Partner” refers to third-party logistics and import service providers, including Imports by Skyjen.

• “Products” refer to goods listed on the Platform.

• “Order” means a purchase placed through the Platform.

2. Nature of the Platform

Shiply Global operates as a digital marketplace and order coordination platform.
We do not manufacture, store, import, or directly deliver products.

All logistics, payments, customs clearance, and delivery are handled by independent fulfillment partners, including Imports by Skyjen.

Shiply Global’s role is limited to:

• Providing the online platform

• Facilitating order placement

• Coordinating communication between users and fulfillment partners

3. Eligibility

To use the Platform, you must:

• Be at least 18 years old

• Have legal capacity to enter into binding agreements under Kenyan law

• Provide accurate and complete information during registration

We reserve the right to refuse service to anyone at our discretion.

4. Account Registration & Security

• Users may be required to create an account

• You are responsible for maintaining account confidentiality

• You accept responsibility for all activities conducted under your account

Shiply Global is not liable for unauthorized access caused by user negligence.

5. Product Listings & Availability

• Product descriptions are provided by suppliers or partners

• Images are illustrative and may differ slightly from actual products

• Availability is not guaranteed and may change without notice

We do not warrant product accuracy, quality, or suitability.

6. Pricing & Payments

• Prices displayed may exclude shipping, customs duties, and taxes unless stated otherwise

• Final payable amounts will be disclosed before order confirmation

• Payments are processed by third-party partners

Shiply Global does not store or process payment card or mobile money details.

7. Orders & Order Processing

• Orders are considered confirmed once payment is acknowledged

• Processing times may vary depending on supplier and logistics factors

• Order confirmation does not guarantee immediate shipment

Shiply Global reserves the right to cancel orders due to errors, fraud suspicion, or supplier limitations.

8. Shipping, Customs & Delivery

• Products are shipped internationally, primarily from China

• Delivery timelines are estimates and not guaranteed

• Customs inspections, delays, or additional charges may occur

Shiply Global is not responsible for delays caused by customs authorities or force majeure events.

9. Returns, Refunds & Cancellations

• Return and refund eligibility depends on supplier and fulfillment partner policies

• Requests must be made within the specified timeframe

• Shipping fees and customs charges may be non-refundable

Shiply Global facilitates communication but does not issue refunds directly.

10. User Obligations

You agree not to:

• Use the Platform for illegal or fraudulent activities

• Provide false or misleading information

• Attempt to interfere with platform operations

• Violate intellectual property rights

Violation may result in account suspension or termination.

11. Intellectual Property Rights

All content on Shiply Global—including logos, designs, text, and software—is owned by Shiply Global or licensed to us.

Unauthorized reproduction or use is prohibited.

12. Third-Party Services

The Platform may contain links or integrations with third-party services.
Shiply Global is not responsible for the content, policies, or practices of third parties.

Use of third-party services is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Shiply Global shall not be liable for:

• Losses resulting from product defects

• Delays in shipping or customs clearance

• Acts or omissions of fulfillment partners

• Indirect, incidental, or consequential damages

Total liability shall not exceed the amount paid by the user for the relevant order.

14. Indemnification

You agree to indemnify and hold harmless Shiply Global from claims arising out of:

• Your misuse of the Platform

• Breach of these Terms

• Violation of applicable laws

15. Suspension & Termination

Shiply Global reserves the right to:

• Suspend or terminate accounts without notice

• Remove content or listings

• Deny future access

This may occur if Terms are violated or for security reasons.

16. Privacy & Data Protection

Use of the Platform is also governed by our Privacy Policy, compliant with the Kenya Data Protection Act, 2019.

17. Force Majeure

Shiply Global shall not be liable for failure to perform due to events beyond reasonable control, including:

• Natural disasters

• Government actions

• Customs restrictions

• Network or system failures

18. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

Any disputes shall be subject to Kenyan courts.

19. Amendments

Shiply Global may update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
